Privacy Policy

Overview
This Privacy Policy describes how FORTYNINE AND A HALF LABS, LLC ("we," "us," or "our") collects, uses, and shares information when you use Flyby ("the App"). Flyby is designed to use the minimum data necessary to provide its features. Most of your personal data never leaves your device.
1. Information We Collect
Location Data
With your permission, we access your device's GPS coordinates to compute which satellites are passing over your position, calculate visibility windows, and display your location name. Your coordinates are stored locally on your device. If you subscribe to Pro daily brief notifications, your approximate coordinates and timezone are transmitted to our servers to schedule your nightly alert. We request location only while the App is in use and do not access it in the background unless you have enabled background notifications through your device settings.
Device Data Stored Locally
The following data is stored exclusively on your device and is never transmitted to our servers:
- Satellite sighting history and log
- Badges and achievements
- App preferences (units, alert timing, notification settings)
- Cached satellite descriptions ("Intel")
- Subscription status
Push Notification Tokens (Pro)
If you enable Pro daily brief notifications, your device's push notification token, approximate location, and your chosen notification time are stored on our servers solely to deliver your daily alerts. You can revoke this at any time by disabling daily brief notifications in the App, which deletes your token from our servers. Tokens are never used for any other purpose.
Analytics Data
We collect anonymous event data about how you interact with the App — such as which screens you view, features you use, and general app performance metrics. This data does not identify you personally and is used only to understand usage patterns and improve the App. It is processed by a third-party analytics service operating under data processing agreements that restrict its use to analytics purposes only.
Advertising Identifiers (Free Tier)
The free tier of the App displays third-party advertisements. On iOS, we request your permission through Apple's App Tracking Transparency framework before accessing your device's advertising identifier. If you grant permission, your advertising identifier may be shared with our advertising partners to show you more relevant ads. If you decline, you will still see ads but they will not be personalized to you based on activity across other apps. You can change this permission at any time in your device's Privacy settings. Flyby Pro subscribers do not see ads and are not subject to advertising identifier collection.
Technical and Server Log Data
When your device communicates with our servers (to fetch satellite data or deliver notifications), standard technical information such as your IP address may appear in server access logs. These logs are used solely for security monitoring and error diagnosis. Logs are retained for a maximum of 30 days and are not used for tracking or profiling.
2. How We Use Your Information
We use the information described above exclusively to:
- Compute and display satellite pass predictions for your location
- Deliver Pro daily brief notifications at your chosen time
- Display advertising to free-tier users (with your consent for personalization)
- Understand aggregate usage patterns to improve the App
- Monitor server security and diagnose technical issues
- Process and verify subscriptions (handled by the App Store)
We do not use your data to build behavioral profiles, make automated decisions about you, or for any purpose not listed above.
3. Information We Share
We do not sell, rent, or trade your personal information. We share data only as follows:
Service Providers
We use third-party service providers to operate the App, including providers for analytics, advertising, push notification delivery, subscription management, and backend infrastructure. These providers are contractually restricted to using your data only to provide services to us and may not use it for their own commercial purposes.
Subscription Processing
Subscription purchases are processed by Apple through the App Store. We receive only anonymized confirmation of your subscription status. We do not receive or store your payment card information.
Legal Compliance
We may disclose information when required by applicable law, court order, or valid legal process, or when we believe disclosure is necessary to protect the rights, property, or safety of the Company, our users, or the public.
Business Transfers
If we are involved in a merger, acquisition, financing, or sale of all or a portion of our business or assets, your information may be transferred as part of that transaction. We will provide notice of any such transfer and any choices you may have to the extent required by applicable law.
4. Data Retention
Data stored locally on your device persists until you delete the App or clear its data through your device settings. Push notification tokens for Pro daily briefs are stored on our servers until you disable that feature, at which point they are deleted. Server access logs are deleted after a maximum of 30 days. Anonymous analytics data may be retained in aggregate, non-identifiable form for longer periods for trend analysis.
5. Your Rights and Choices
Location Access
You can revoke location permission at any time in your device settings. The App will continue to function using a manually set location, but predictions will be less precise.
Advertising Tracking (iOS)
You can change your advertising tracking consent at any time under Settings → Privacy & Security → Tracking on your iPhone.
Notifications
You can disable all notifications at any time in your device settings, or manage specific alert preferences within the App.
Deletion
All locally stored data is deleted when you uninstall the App. To request deletion of any server-side data (such as your push token), contact us at support@flyby.app and we will process your request within 30 days.
California Residents (CCPA / CPRA)
California residents have the right to know what personal information we collect and how it is used, to request deletion of their personal information, to correct inaccurate personal information, and to opt out of the sale or sharing of their personal information. We do not sell personal information. To exercise your rights, contact us at support@flyby.app. We will not discriminate against you for exercising any CCPA right.
EEA, UK, and Switzerland Residents (GDPR / UK GDPR)
If you are located in the European Economic Area, United Kingdom, or Switzerland, you have the right to access, rectify, erase, and port your personal data, and to object to or restrict certain processing. Our legal bases for processing are: consent (location data, advertising identifier); legitimate interests (analytics, server security logs); and contract performance (push notification delivery for Pro subscribers). To exercise your rights, contact us at support@flyby.app. You also have the right to lodge a complaint with your local data protection authority.
6. Children's Privacy
The App is rated for ages 4 and up. We do not knowingly collect personal information from children under 13 beyond the location data described in this policy and only with verifiable parental consent where required by applicable law (including COPPA in the United States). On iOS, advertising personalization for users who have not consented via ATT is disabled by default, which limits data collection from younger users.
If you are a parent or guardian and believe your child has provided personal information to us that was not appropriately authorized, please contact us at support@flyby.app and we will promptly delete it.
7. Security
We implement industry-standard security measures, including HTTPS encryption for all data in transit. However, no transmission or storage method is completely secure. We cannot guarantee absolute security and disclaim liability for unauthorized access beyond our reasonable control.
8. International Data Transfers
The App is operated from the United States. By using the App from outside the United States, you acknowledge that your information may be transferred to, stored in, and processed in the United States or other countries, which may have data protection laws that differ from those in your jurisdiction. Where required by applicable law, we ensure appropriate safeguards are in place for such transfers.
9. Changes to This Policy
We may update this Privacy Policy at any time. We will indicate the date of the most recent revision at the top of this document and, where practicable, provide in-app notice of material changes. Your continued use of the App following any update constitutes your acceptance of the revised policy.
